This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site. 1. What information do we collect about you?

Like many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we use third party services such as Google Analytics that collect, monitor and analyse this data for sales, marketing and management reporting purposes. We also use this Log Data to improve the content, quality and usability of our Site.

Limited personal information

Modern Networks Ltd only collects limited personal information (data that can identify you individually) if you request information from us for business purposes. Personal information may include your name, postal address, and/or email address. We might ask for additional personal information in the event that you download a white paper, request services or contact sales support. Such other personal information may include your company name, job title and department, telephone and mobile number.

Modern Networks Ltd collects your personal information in order to record and support your participation in the activities you select. If you subscribe to a newsletter, for example, the information is only used to provide you with that specific service without you have requested additional services. We will only use your personal information for sales and marketing purposes where you have expressly opted-in to receive such communications.


2. How will we use the information about you?

Communications & marketing

You may browse our website as you wish, and you will remain an anonymous user until you fill out one of our lead capture forms or otherwise provide your email address to us. We may send you promotional emails about our various products and services. Each such communication, whether direct or by email, will include instructions for removing your name from this distribution list. In the case of email, use the link provided within the communication to opt-out or unsubscribe from future mailings. All such mailings will originate from Modern Networks Ltd or one of Modern Networks Ltd’s business partners, such as HubSpot, and each such mailing will clearly identify the source of the mailing. Emails sent from Modern Networks Ltd include a link allowing you to unsubscribe from receiving further emails. Use of HubSpot

We use HubSpot, a comprehensive inbound marketing and sales platform, to enhance our email marketing efforts and manage our landing pages and response forms. HubSpot helps us attract visitors, convert leads, and engage with our audience through targeted email campaigns and efficient form management. HubSpot allows us to collect and process personal data, including contact information and website usage data, to improve our marketing efforts and personalise your experience.

Data Collection and Processing

PureChat instant messenger

Modern Networks uses PureChat, which is an instant messaging tool that allows website visitors to communicate with a member of Modern Networks staff in real-time. The popup chat box allows the user to call us by phone, email us or start a web chat using the contact form provided. The PureChat application automatically saves a transcript of the online conversation. Once an enquiry has been successfully answered, the transcript and all related personal contact information is deleted from the PureChat system. ConnectWise Chat

ConnectWise Chat is an online chat tool that enables our support engineers to respond to technical queries in real-time. The tool also provides our engineers with the ability to work remotely on a client’s computer, making diagnostics and repairs a faster and more efficient process. ConnectWise Chat automatically records every conversation and the amount of time spent on a task. This transcript is logged against a new or existing service ticket, and provides SLA (service level agreement) performance data.

Call Recording

In order to maintain our high standards of customer service and technical support we occasionally record telephone calls for training purposes. If a caller wishes to withhold consent they should end the call immediately, and use email or our instant messaging service to request a call back. We will ensure that the use of these recordings is fair and that we comply with the requirements of the relevant legislation:

  • Regulation of Investigatory Powers Act 2000 (“RIPA”)
  • Telecommunications (Lawful Business Practice)(Interception of Communications) Regulations 2000 (“LBP Regulations”)
  • EU General Data Protection Regulations (GDPR) 2018
  • Telecommunications (Data Protection and Privacy) Regulations 1999
  • Human Rights Act 1998

If it becomes clear that a call is private or the person making the call says that they do not wish to have their call recorded, the call will be stopped.

Call recordings are only available to members of staff for training purposes where they have been assigned user privileges to do so. Call recordings are held on a secure, password protected server. Call recordings are not linked to customer contact records, so preserving anonymity. Call recordings cannot be downloaded, shared or exported by staff. We currently have a retention period of 6 months after which call recordings are deleted automatically, unless they are placed into “legal hold”. This is a measure to prevent calls being deleted as part of the retention policy if the call is required for a legal investigation.

Recruitment & Human Resources (HR)

Modern Networks Ltd only collects and uses personal information that is essential to conduct recruitment, human resources and business functions. For example, Modern Networks Ltd collects and uses personal information for recruitment, payroll, human resources and health and safety purposes.

All CVs submitted as part of the recruitment process will only be held on file for 6 months, after which they will be automatically deleted.

We recognise that all personal information must be protected, Modern Networks Ltd exercises special precautions and safeguards for sensitive data such as employee records. Unless required by UK/EU law and legitimate business interest, Modern Networks Ltd does not request or record sensitive data.

Non-disclosure

Modern Networks Ltd will not disclose any of your personal information, except as described below, or when we believe in good faith that the law requires it, or to protect the rights or property of Modern Networks Ltd or others. If compelled by law to divulge your personal information to comply with laws or regulations of a governmental or regulatory body or in response to a valid subpoena, warrant, or order or to protect the rights of Modern Networks Ltd or others, Modern Networks Ltd will use its best business judgment to minimize such compelled disclosures.

Modern Networks Ltd does disclose aggregated user statistics and demographic information (for example, the geographic spread of our customer inquiries) in order to describe our services to prospective partners, advertisers, and other third parties, and for other lawful purposes. If and/or when we do match user information, we endeavour to keep personal information confidential from those third parties.


3. How do we store and secure your information?

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. Therefore, you agree that you do so at your own risk and you assume any associated liabilities.

Modern Networks Ltd take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.

Personal information exchange between this site and its users happens over a SSL (Secure Socket Layer) secured communication channel and is encrypted and protected with digital signatures. The site also uses an endpoint firewall and malware scanner to help identify and block malicious traffic.

Storage of personal information you provide will be either on our secure servers, which are password and firewall protected. Alternatively, it will be on our secure internal network, which is also secured by a password and firewall.

Additionally, Modern Networks Ltd applies administrative and access control policies, enterprise anti-virus, regular updating or “patching” of all devices and applications in accordance with security best practice.


4. How long do we retain your information?

Unless there is a specific legal requirement for us to keep your personal information, we will retain it for no longer than is necessary for the purposes for which the data was collected or will be used in the future, such as monthly billing.

We periodically perform data cleansing to ensure that the information we hold is accurate and up to date.

The company only retains data such as financial records and legal correspondence for the required statutory periods under UK/EU law and for regulatory compliance purposes.


5. Access to your information and corrections

You have the following rights in relation to the personal information we hold about you:

  • Right of access. If you ask Modern Networks Ltd, we will confirm whether we are processing your personal information and, if so, provide you with a copy of that personal information.

6. Cookies and IP addresses

Modern Networks Ltd uses cookies in various ways to track your visit to our website, but this information is not used to identify you personally.

We use cookies to determine which of our visitors are interested in our products and services. You will remain an anonymous user until you fill out one of our lead capture forms, at which time your information will be used by our marketing and sales departments. Our lead capture form is clearly identified as such.

Cookies may also be used to estimate the size of our visitor base. Each web browser that accesses our website is given a unique cookie, which is then used to determine repeat usage versus initial usage.

We use Google Analytics to conduct anonymous web traffic analysis for our website. While Google Analytics makes use of cookies, no personal information is ever collected or analysed by this service.
